Litigation We’re Watching

Trump v. Anderson, et al. (February 8, 2024; United States Supreme Court, Case No. 23-719). The United States Supreme Court heard oral argument in the matter of the State of Colorado disqualifying Donald Trump from the State’s presidential ballot. Many of the Justices appeared skeptical of Colorado’s actions to bar Trump from the ballot on the basis of Section 3 of the 14th Amendment of the United States Constitution, which bars officials who have sworn to support the Constitution from serving in government if they engage in insurrection. Court observers expect a quick ruling on the matter to provide clarity to the electorate, with many anticipating a reversal of the Colorado Supreme Court — allowing Trump’s name to appear on Colorado ballots. January 4, 2024: Former Lodi City Councilmember Shakir Khan plead no contest in an election fraud case in San Joaquin County. Kahn was charged with fraudulently registering several dozen individuals as voters, and holding over 40 ballots at his home.

Fair Political Practices Commission News – At the January Fair Political Practices Commission meeting, staff presented the proposed regulatory projects for 2024. Among these proposals, staff would like to: update and reorganize regulations governing streamline penalties; modify how the 70% threshold is calculated for primarily formed committees; and allow general purpose committees and political party committees to transfer all purpose funds to interest-bearing accounts

New Legislation

State Legislation – The following bills have been introduced since the Legislature reconvened on January 3. February 16 is the bill introduction deadline. AB 1784: States the intent of the Legislature to enact legislation established that a person is prohibited from filing nomination documents for more than one office at the same election.
